Welcome to Oceanbox Designs. This website, oceanboxdesigns.com, is operated by Oceanbox Designs LLC. Throughout these Terms, “Oceanbox Designs,” “we,” “us,” and “our” refer to Oceanbox Designs LLC.

These Terms of Service govern your use of our website and purchases from our online store. Our Privacy Policy, Refund Policy, and Shipping Policy form part of these Terms.

By using our website or placing an order, you agree to these Terms. If you do not agree, please do not use the website or place an order.

1. Website Use and Purchasing

You must be legally able to enter into a binding agreement to place an order. If you are under the age of majority where you live, a parent or legal guardian must authorize and oversee your purchase. You agree to use our website lawfully and provide truthful information when communicating with us or placing an order.

You must not:

• Use the website to commit fraud or other unlawful activities.
• Upload harmful software or attempt to access accounts or systems without permission.
• Interfere with the website’s operation or security.
• Infringe intellectual property rights.
• Submit fraudulent orders, reviews, or claims.

We may restrict access when reasonably necessary to address misuse, fraud, or security concerns.

2. Product Information and Compatibility

Please review each product’s description, dimensions, compatibility requirements, and instructions before purchasing. Product photographs illustrate appearance. Colors may vary depending on lighting and screen settings. Products made or finished individually may have minor variations that do not affect their intended function.

Any accessories, aquarium livestock, phones, or other equipment shown in photographs are excluded unless the listing specifically states that they are included. If you are unsure whether a product suits your equipment or intended application, contact us before ordering.

3. Prices, Payments, and Promotions

Prices are shown in U.S. dollars unless otherwise indicated. Applicable shipping charges, taxes, and discounts are displayed at checkout.

Payment must be successfully authorized and fully charged before we process your order. Payment processing is subject to the applicable payment provider’s terms.

Promotional offers may have eligibility requirements, expiration dates, and exclusions. Discounts cannot be combined unless the offer expressly permits it.

Price changes apply to future purchases and do not change the price of an existing order.

4. Orders and Account Information

You are responsible for providing an accurate email address, delivery address, and billing information. Please contact us promptly if you discover an error.

An order confirmation acknowledges receipt of your order. We may decline or cancel an order because of unavailable inventory, suspected fraud, payment failure, shipping restrictions, or a material listing error. If we cancel an order after collecting payment, we will refund the amount paid for the canceled items and any associated charges.

Paid orders cannot be modified. If you need to correct your address or order details, contact us promptly to request cancellation before placing a new order. Cancellation depends on production and fulfillment status. Approved customer-requested cancellations incur a 3.5% transaction-fee deduction on the original paid total.

5. Production, Preorders, and Shipping

Processing and production times may vary by product. Review the product listing and our Shipping Policy for the applicable estimate.

For preorders or products made to order, any stated shipping date is an estimate unless expressly guaranteed. We will communicate material changes to the expected fulfillment schedule.

Carrier transit estimates are separate from our processing time. Weather, customs processing, and carrier disruptions can affect delivery.

If your shipment is delayed, damaged, or appears lost, contact us so we can help investigate and determine the appropriate resolution.

6. International Orders

International orders may be subject to import duties, VAT, taxes, or customs-related carrier fees assessed in the destination country. Unless checkout expressly states that these charges are included, they are excluded from your checkout total and are the recipient’s responsibility. These charges are assessed by customs authorities or carriers and are not additional charges collected by Oceanbox Designs.

7. Returns and Refunds

Our Refund Policy explains the return process and applicable conditions.

For approved returns unrelated to manufacturing quality:

• A return must be requested within 15 days of delivery.
• Products must be unused and in their original packaging.
• Eligible returns are subject to a 20% restocking fee.
• Used or installed products and clearance products are not eligible for ordinary returns.

The 20% restocking fee does not apply when our inspection of the returned product confirms a manufacturing defect or manufacturing quality issue.

Ordinary return exclusions do not remove rights relating to defective, damaged, or incorrectly supplied products under applicable law or an applicable product warranty.

Contact us before sending a return. Return authorization does not guarantee a refund; returned products must first be received and evaluated.

8. Product Use and Warranties

Use products only for their intended purpose and follow the supplied instructions, including mounting, load, glass-thickness, electrical, and submersion limits where applicable.

A submersible accessory does not make an attached phone or other equipment waterproof. Only components expressly identified as submersible should be placed underwater, within their stated limits.

Inspect products periodically and stop using any product that shows damage, deterioration, or insecure attachment. Any written product warranty applies according to its stated coverage and conditions.

These Terms do not override an express warranty or any consumer rights that cannot legally be excluded.

Aquarium conditions vary, and we do not guarantee particular coral growth, livestock health, or photographic results.

9. Intellectual Property

Purchasing a product does not grant ownership of associated intellectual property rights. Website text, photographs, videos, graphics, branding, and other original materials belong to Oceanbox Designs or their respective rights holders. You may view and share links to our public pages for personal purposes. Copying or commercially using our protected content requires permission unless permitted by law.

10. Reviews, Feedback, and Customer Content

Reviews and submissions must reflect your honest experience and must not contain unlawful material, confidential information, or content that violates another person’s rights. When you submit a review for publication on our website, you give us permission to display it and make reasonable formatting edits without changing its meaning.

Tagging @oceanboxdesigns on social media does not, by itself, grant us permission to use your content in advertising. Commercial use of customer or creator content requires permission or a separate agreement.

We may include links to unaffiliated third-party websites in product information or articles when we find them helpful. These links do not imply endorsement. We do not control those websites and are not responsible for their content, policies, or practices.

Their services may be subject to separate terms and privacy policies. Links to external websites are provided for convenience. We do not control their content or practices.

13. Website Availability and Errors

We strive to keep our website accurate, but errors may occur in text, images, pricing, promotions, shipping charges, or availability. We may correct these without prior notice. If an error affects your order, we may cancel it or request your approval to proceed with corrected details. Canceled items and associated charges will be refunded if payment has been collected.

14. Limitations of Liability

To the extent permitted by applicable law, Oceanbox Designs is not liable for indirect or consequential losses arising from website use or product use, including lost profits or business interruption. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or any applicable statutory consumer protections.

15. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Oceanbox Designs LLC and its personnel and service providers from third-party claims, including reasonable attorneys’ fees, arising from your breach of these Terms, violation of law or others’ rights, or misuse of our products. This does not cover claims resulting from our negligence, misconduct, or product defects for which we are legally responsible.

16. Governing Law

These Terms are governed by the laws of the State of Texas and applicable United States federal law. If mandatory consumer protections in your place of residence apply to your purchase, those protections remain available to you.

17. Changes and Revisions

We may update these Terms at any time without advance notice. Changes apply prospectively and do not retroactively reduce rights associated with an existing purchase. If a provision is found unenforceable, the remaining provisions continue to apply. These Terms, the policies referenced above, and any applicable written product or order terms form the agreement governing your website use and purchase.
